SALES CONTRACT

1. PREMISE
These general conditions concern the purchase of products remotely via telematics network through the website “www.ducatihome.it”. The conditions of purchase are regulated by the provisions of the Consumer Code (Legislative Decree 206/2005), while the protection of confidentiality (privacy) is regulated by the provisions of Legislative Decree 196/2003. These general conditions are valid from 1 February 2015 and may be updated or modified by the owner of the site at any time, without notice, and will be valid from the date of publication on the website “www.ducatihome.it”.

2. ACCEPTANCE OF THE CONDITIONS OF SALE
The conditions set out in the introduction are an integral and substantial part of this contract. The purchase contract for material goods will be concluded by the end consumer (“Customer”) with the selling company directly by accessing the website “www.ducatihome.it” carefully following the instructions and procedures provided. After having read the general conditions of sale, by confirming the order the Customer will accept the terms and conditions of sale reported on the site and will authorize ducatihome.it at the time of sending, to charge him the total amount indicated, including the contribution for shipping costs. The order number that will be assigned at the time of purchase confirmation is generated progressively and is necessarily unique.

3. PRODUCT AVAILABILITY
Ducatihome.it accepts orders for products within the limits of the quantities existing in stock. Therefore, acceptance of the purchase proposal is subject to the availability of the Products in stock.
Ducatihome.it undertakes to promptly communicate to the Customer any unforeseeable stock shortages due to excess demand or other causes.
Ducatihome. will be free to supply an ordered product that is out of stock or otherwise unavailable by supplying a different item but with the same functionality and specifications (for example, supplying a different model of radio control with the same compatibility and/or functions). Ducatihome will be free to supply a product with a free up-grade to a similar product but of a higher level in terms of characteristics and technical specifications, which can therefore be used by the buyer in the same way as the ordered product (for example, supplying a gate opener kit with an electronic board of a different model than the one originally included in the purchased kit, but with the same characteristics and functionality or even of a higher level and therefore with more functionality than the one ordered).

4. SALES PRICES
The validity of the prices indicated is always and only that indicated by the procedure (order form) at the moment the order is sent to the seller. Prices may vary without prior notice and the only correct price is to be understood as the one indicated at the time of confirmation of the order by ducatihome.it.

5. CUSTOMER OBLIGATIONS
The Customer undertakes and is obliged, once the online purchase procedure has been concluded, to print and keep these general conditions, which he/she will have already viewed and accepted. The Customer declares that he/she is of age, and that the data provided by him/her are correct and truthful. The Customer is prohibited from entering false and/or invented and/or imaginary data in the registration procedure for the execution of this contract and for the related communications. It is expressly forbidden to make double registrations or enter third party data. The Customer will in any case hold ducatihome.it harmless and indemnified from any liability arising from the issuing of incorrect documents, incorrect tax data or any other data provided by the Customer in violation of third party rights, the Customer being solely responsible for the correct and truthful entry of the same.
6. PAYMENT The payment methods are those made available on the site at the time of conclusion of the order.

7. INVOICING
Invoicing takes place at the same time as the approval of the online order. The information provided by the Customer at the time of ordering will be used to issue the invoice. After the invoice has been issued, it will not be possible to make any changes to the data indicated in the invoice. If, due to non-delivery and/or withdrawal, a credit note will be issued.

8. WARRANTY
The manufacturer's warranty and assistance applies to the products purchased by the Customer. The Customer declares to have read and accepted the warranty conditions and the after-sales assistance procedures. More precisely:

JURISDICTION AND COMPETENT FORUM
This contract is subject to Italian jurisdiction. These general conditions, unless expressly provided, refer to the rules on distance purchase contracts (in this case distance contracts via telematic network) of the civil code, Legislative Decree 185/1999, Legislative Decree 70/2003 and Legislative Decree 206/2005. Any dispute relating to the application, execution, interpretation and termination of this contract will be devolved to the exclusive jurisdiction of the Court of Parma (Italy).
